In brief

  • The changes commenced on 2 October 2026; they do not cancel an existing Student visa.
  • Onshore application exemptions and family-inclusion exemptions are separate questions.
  • Where offshore lodgement is required, offshore grant is also required. An offshore application does not give an Australian bridging visa.

This is a summary, not a complete exemption test. Check the current rules and your own circumstances before making study, travel or application decisions.

What changed—and what did not

Home Affairs states that new rules for subclasses 500 and 590 apply from 2 October 2026. They change who can apply for and be granted a visa while in Australia, and when family members can be included.

The changes may affect current Student visa holders applying for another Student visa, not just people changing from another temporary visa. They do not, by themselves, change the current Student visa already held.

Home Affairs says Student applications lodged before commencement continue under the rules in place when lodged. Application validity and the relevant transitional provisions still need checking in an individual case.

Check the applicant’s visa and application location

Most affected temporary visa holders must be outside Australia at lodgement and grant. The Department’s affected-visa list must be checked; do not assume every temporary visa has identical rules.

Current Student visa holders generally need offshore lodgement for a further Student visa unless a limited onshore exemption applies. A Student dependant seeking to become a primary Student applicant must lodge offshore and be offshore at grant; Home Affairs states there are no exemptions to that rule.

Current Student Guardian 590 holders can continue to lodge a further Student Guardian application in Australia. This is not a general exemption allowing them to apply onshore for a Student 500 visa.

Onshore exemptions have specific conditions

Published Student-holder exemptions include certain same-provider course-completion extensions, DFAT or Defence sponsorship, PhD or school studies, specified course progression and provider default. The relevant exemption must actually fit the applicant.

For example, the completion extension is limited to up to 12 more months after the original course end date, with the same provider and the main course where courses are packaged. Higher-AQF progression requires completion of the relevant main course; after higher education, the next course must also be higher education delivered by a higher education provider.

These examples are not the full test. A new Confirmation of Enrolment or continuing to hold a Student visa is not enough on its own.

Family inclusion is a separate assessment

The published application-stage exemptions include PhD students, DFAT or Defence-sponsored students, foreign-government scholarship recipients and eligible students from Pacific or ASEAN countries. Separate continuation arrangements may apply to family already included on a current Student visa, including qualified course-completion or provider-default cases.

The primary applicant and included family must be in the same location at lodgement. Home Affairs states that subsequent entrants cannot be added after the Student visa is granted, with no exemptions to that post-grant rule. Do not transfer application-stage exemptions to the post-grant restriction.

Before enrolling, travelling or applying

Confirm the current visa, expiry, application and decision locations, any relevant exemption and the position of each family member. An application lodged onshore when offshore lodgement is required will be invalid; an offshore application does not create an Australian bridging visa.

Seek advice before making financial or travel commitments. Booking a consultation does not lodge an application, extend a visa or preserve a deadline.
