Character Requirements — Section 501

Character concerns can involve different legal processes. Identify whether the correspondence concerns a proposed decision, a mandatory cancellation, a revocation request or an existing decision before responding.

Office hours Monday–Friday, 9 am–5 pm. Not a 24/7 service. To book, choose a time first, then complete the visitor registration form.

Check the notice and response deadline first.

A Department concern is not necessarily a final refusal or cancellation. Identify the exact notice, legal basis and required response before acting.

  • Deadlines. Response periods depend on the notice, notification rules and applicable law. Verify the deadline and submission method promptly. Any extension must be available under the process and confirmed; do not assume that requesting one pauses the deadline.
  • Status. A Department notice, a response or a waiver request does not itself extend a visa, grant a bridging visa or create work or travel rights. Check the visa actually in effect and its conditions separately.
  • Booking. Booking, contacting iExcel or completing visitor registration does not submit a response to the Department, pause a response deadline or extend your visa.
  • Documents. If available, the notice and decision-related correspondence, the response deadline, visa details and relevant application records can help. Do not delay first contact while collecting a complete file; documents are not a prerequisite for booking.

Important cautions

  • A criminal record, pending charge and statutory character-test failure are not interchangeable. The actual test and consequences require individual assessment.
  • A request for revocation is not an ART application and does not share a universal filing deadline with an ART review.
  • A statement, revocation request or review does not itself guarantee reinstatement, lawful status or permission to work.
  • Assistance is within registered migration agent services. Serious criminal proceedings, detention, removal or court judicial review may require advice from an appropriately qualified Australian legal practitioner.
  • An explanation, correction or supporting submission does not guarantee that a concern will be resolved, a waiver exercised or a visa granted. Outcomes depend on the facts and applicable law.

What this page covers

Section 501 provides character-related refusal and cancellation powers. Accurate disclosure and the specific statutory process are central; criminal history does not produce one universal outcome.

Important distinctions

Proposed refusal or cancellation
Where an opportunity to respond is provided, address the relevant character concerns, legal criteria and response instructions. Do not assume every decision follows the same advance-notice process.
Mandatory cancellation and revocation
Mandatory cancellation can involve a separate opportunity to request revocation. A revocation request to the Department is not an ART review application; the applicable requirements and deadlines must be checked separately.
ART or court proceedings
Not every character decision is ART-reviewable. The decision-maker and legal power matter. Court judicial review is different from merits review and may require an appropriately qualified Australian legal practitioner.

How the process works

  1. Identify the precise notice or decision, legal power, decision-maker and notification details.
  2. Check the current process and exact deadline rather than apply a generic cancellation timeframe.
  3. Review the character questions, court records, previous disclosures and relevant personal circumstances.
  4. Prepare truthful submissions and evidence within the authorised migration service scope.
  5. Assess status and any separately available revocation, review or legal assistance needs.

Documents that may help (optional at first contact)

  • The actual Department notice or decision and relevant application history, if available.
  • Court and sentencing records, police certificates and relevant disclosure history.
  • Information addressing the character concerns and relevant personal or family circumstances.
  • Existing revocation or Tribunal correspondence, if a process is already underway.

How we help

  • Assess the character-related immigration correspondence and relevant migration process.
  • Review disclosures, records and supporting evidence, and prepare migration submissions within scope.
  • Explain when the matter may require specialist legal assistance rather than imply court representation is included.
