PIC 4020 — Documents & Identity
The Department has raised concerns about documents, information or identity. Understand the allegation and applicable criterion before preparing an accurate, evidence-based response.
Office hours Monday–Friday, 9 am–5 pm. Not a 24/7 service. To book, choose a time first, then complete the visitor registration form.
Check the notice and response deadline first.
A Department concern is not necessarily a final refusal or cancellation. Identify the exact notice, legal basis and required response before acting.
- Deadlines. Response periods depend on the notice, notification rules and applicable law. Verify the deadline and submission method promptly. Any extension must be available under the process and confirmed; do not assume that requesting one pauses the deadline.
- Status. A Department notice, a response or a waiver request does not itself extend a visa, grant a bridging visa or create work or travel rights. Check the visa actually in effect and its conditions separately.
- Booking. Booking, contacting iExcel or completing visitor registration does not submit a response to the Department, pause a response deadline or extend your visa.
- Documents. If available, the notice and decision-related correspondence, the response deadline, visa details and relevant application records can help. Do not delay first contact while collecting a complete file; documents are not a prerequisite for booking.
Important cautions
- Using a third party does not automatically prevent an adverse PIC 4020 finding. Do not assume an explanation that an agent prepared the material is sufficient.
- Not every error or discrepancy establishes a PIC 4020 breach. Assess materiality, the document or information and the applicable provision.
- Not all PIC 4020 requirements are waivable; identity requirements must be assessed separately.
- An explanation, correction or supporting submission does not guarantee that a concern will be resolved, a waiver exercised or a visa granted. Outcomes depend on the facts and applicable law.
What this page covers
Public Interest Criterion 4020 applies to specified visa applications. A discrepancy is not automatically proof of bogus documents or materially false or misleading information.
Important distinctions
- Documents and information
- The criterion addresses bogus documents and information that is false or misleading in a material particular, in the circumstances specified by the Regulations. The actual document, connection to the application and relevant provision matter.
- Identity is a separate requirement
- Satisfying the Minister as to identity is distinct from document or information concerns. The waiver in PIC 4020(4) covers specified document/information requirements and related previous refusals—not the identity requirements in subclauses (2A) and (2B).
- Future visa consequences are provision-specific
- PIC 4020 includes a three-year look-back for certain document/information refusals and a ten-year look-back for certain identity refusals, with the assessment period extending to the new decision. Relevant family members and specific under-18 exceptions can matter. These are not universal bans on every Australian visa: assess the applicable criteria, dates and any limited waiver individually.
How the process works
- Identify the specific PIC 4020 concern, response deadline and information relied on.
- Review the application history and the provenance of the disputed documents or information.
- Obtain relevant originals, issuing-body records or other independent verification where appropriate.
- Prepare truthful explanations that address each allegation and the applicable criterion.
- Respond through the required channel in time and assess any subsequent decision separately.
Documents that may help (optional at first contact)
- The Department notice and application records, if available.
- Disputed documents, originals and relevant issuing-body verification.
- Correspondence with preparers or third parties and evidence explaining any inconsistency.
- Identity or other records relevant to the particular criterion. This is not a universal checklist.
How we help
- Review the allegations and relevant visa and application history.
- Identify the applicable criterion, evidence gaps, potential consequences and any limited waiver questions.
- Prepare accurate explanations and supporting migration submissions addressing the concerns.

About PIC 4020 — Documents & Identity
No. The Department must apply the relevant criterion to the facts. Identify the precise document, information or identity concern rather than assume any inconsistency establishes a breach.
PIC 4020 can still be relevant. Review who supplied the material, the circumstances and the statutory requirements. Third-party involvement is not an automatic defence.
Different PIC 4020 provisions involve different periods and findings. Their effect depends on the criteria of the visa sought and the particular history; they are not a blanket prohibition on every visa.
Limited waiver provisions apply to some requirements, not all. Identity requirements are separate and must not be treated as covered by a document/information waiver.
Provide truthful information and obtain advice on the relevant correction and response obligations promptly. A correction does not automatically resolve a previous concern or guarantee an outcome.
